At Emmet Internet (“Emmet,” “us,” “we,” or “our”), we value the privacy and security of our customers’ personal information. This Privacy Policy outlines the types of customer personal information we collect, use, disclose, retain, secure, and dispose of. It applies to visitors and users of Emmet’s website, https://emmetinternet.com (“Site”), as well as applicants, current, and former residential and commercial/business customers of our high-speed internet access services (individually, “Service” and collectively, “Services”) residing in the United States. For the purposes of this policy, all such visitors, users, applicants, current, and former customers are collectively referred to as “Customers,” “you,” and “your.” Capitalized terms used herein have the same meaning as defined in the Emmet Service Agreements.

By using Emmet’s Site and Services, Customers consent to the data practices described in this Privacy Policy, including the collection, use, disclosure, and disposal of your personal information. Emmet’s Site and Services are designed and targeted to U.S. audiences and are governed by and operated in accordance with U.S. laws. If you are not a U.S. citizen or do not reside in the U.S., you consent to the collection, transfer, use, disclosure, and retention of your personal information in the U.S. You also agree to waive any claims that may arise under your national laws.

1. General Information

When you use the Service, the personal information you voluntarily send and receive is transmitted over a wireless network and may be subject to interception by unauthorized third parties. While we aim to take reasonable measures to reduce the risk of interception, we cannot guarantee that transmissions over the internet are 100% secure or error-free. Emmet does not knowingly collect, solicit, or use personal information from anyone under the age of 13. If you are under 13, please do not attempt to register for the Services or send any personal information about yourself to Emmet. If we learn that we have collected personal information from a child under 13, we will delete that information as quickly as possible. 2. What Types of Information Do We Collect and How Do We Use This Information?

Generally, personal information is information you provide to Emmet Internet voluntarily or passively through your use of our Services and/or Site. This information identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked directly or indirectly with you or your household. This includes information from both our residential and commercial/business customers and their end users. The following are the various ways and reasons we collect personal information:

(i) Registration, Billing, and Administration:

We collect personal information such as your name, email address, phone number (wireless and wireline), billing address, payment information (credit card or other financial account details), service address, and information about the devices or other property making use of our Service. We also use this information for the installation, troubleshooting, maintenance, and servicing of your Services.

(ii) Social Network Platforms:

Emmet Internet has a presence on social media platforms like Facebook and Nextdoor. You voluntarily engage with our social media content at your level of interest. Please note that interactions on these platforms are governed by the privacy policies of the respective platforms. We may obtain and merge public information posted on social media, but we will not share your personal information with third parties except as described in this Privacy Policy.

(iii) Website Information, Cookies, and Other Tracking Technologies:

When you visit Emmet’s Site, we collect information through server logs from your browser or device. This may include your IP address, unique device identifier, cookie information, browser type, and requested pages or features. Cookies and web beacons are text files transferred to your browser or device that help us recognize your device and track usage patterns. You can adjust your browser settings to block or limit cookies, but this may impact your ability to access certain features on our site.

If you click on links to third-party websites, those websites may also use cookies, but we are not responsible for their privacy practices.

(iv) Enhancing Our Website and Service Offerings:

We use personal and non-personal information to improve the functionality of our website and the offerings of our Services. For example, data on how often users engage with certain features helps us enhance the user experience. We may introduce new technologies and monitoring techniques in the future without prior notice, and we may use third-party providers for internal analyses.

(v) Network Information:

We collect network information related to your access and use of Emmet’s network. This includes details about the performance of our equipment on your premises, data transmission amounts, and website usage. We aggregate network information from multiple customers and may share non-personal information with our affiliates or third parties. This aggregated information does not identify specific individuals.

Emmet Internet may monitor network usage for performance enhancement or in response to specific inquiries, issues, or legal requirements. However, we do not monitor the content of the websites you visit or your email communications as part of standard network management.

3. Is Personal Information Used for Marketing and Advertising Purposes?

Emmet Internet may use Customer Personal Information to send marketing and advertising messages related to our own Services and Site using Customer’s email address, postal address, or telephone number (for voice, texts, automated, and pre-recorded calls). Emmet Internet may deliver a marketing or advertising message based on Customer visits to the Emmet Internet website, which will be general advertising or “Contextual Advertising,” based on the subject matter or the content of the specific webpage.

Emmet Internet may also send Customer “First Party Advertising,” which is customized or personalized based on a history of Customer’s use of our Services, possibly combined with information from our Facebook fan page or other social network platforms. First Party Advertising is based solely on information Emmet Internet collects from the Customer—not from Customer’s visits to other websites across the Internet. Customers may opt out of First Party Advertising but not Contextual Advertising. No Personal Information is used to deliver Contextual Advertising, which will automatically appear based on the content or webpage the Customer is viewing. Customers will continue to receive general advertising if they opt out of First Party Advertising; however, it will not be customized or personalized.

Emmet Internet does not provide third-party “Network Advertising,” which is advertising based on Customer’s overall Internet usage across different third-party websites or online services. Since Emmet Internet does not engage in network ads, we do not recognize “Do Not Track” settings on browsers. We also do not allow third parties to track Customers across the Internet for advertising purposes.

4. Links to Third-Party Websites and Services

The Emmet Internet Site and/or our Facebook Pages (or other social networking platforms) may contain links to third-party websites or online services. Despite these links, this Privacy Policy applies only to Emmet Internet and our Affiliates. The presence of a link does not imply Emmet Internet’s endorsement, recommendation, or sponsorship of the content, goods, services, or privacy practices on those websites or services. Emmet Internet encourages Customers to be informed when leaving Emmet Internet’s Site or Facebook Pages and any other social networking platforms.

5. Do We Disclose Customer Personal Information to Third Parties?

Customer’s Personal Information will only be disclosed to third parties (including Emmet Internet’s Affiliates) as outlined in this Privacy Policy or if Emmet Internet has received your consent at the time of collection or prior to disclosure. Emmet Internet reserves the right to use, disclose, and process any non-Personal Information collected from Customer as well as any information made public via Emmet Internet Services or Site.

  • To Our Operational Service Providers: Emmet Internet contracts with other companies to perform tasks or services on our behalf and shares Customer Personal Information to provide products or services. For example, Emmet Internet may use a payment processing company for ACH or credit card transactions or contract third parties to assist with optimizing Emmet Internet’s network. Unless otherwise stated, Emmet Internet does not grant Operational Service Providers the right to use the Personal Information beyond what is necessary to assist Emmet Internet.

  • For Business Transfers/Restructuring: Emmet Internet may buy or sell assets or undergo restructuring, reorganization, or financing. In these transactions, Customer Personal Information may be disclosed or transferred as one of the business assets. If Emmet Internet is acquired or undergoes any change of control, Personal Information may be disclosed or transferred to a third party.

  • For Protection of Emmet Internet and Others: Emmet Internet may access, read, preserve, and disclose any Personal Information if necessary to enforce the Service Agreement, Website Terms of Use, Privacy Policy, or other legal documents; protect our assets or services; or ensure the safety of Emmet Internet, our Affiliates, employees, Operational Service Providers, Customers, or the general public.

  • When Required by Law or in Response to Legal Process: Emmet Internet may access, read, preserve, and disclose Personal Information when required by law or legal process, or if we have a good faith belief that disclosure is required to comply with legal obligations.

6. How Do We Protect Customer Personal Information?

Emmet Internet takes reasonable administrative, technical, and physical security measures to protect Customer Personal Information. However, we cannot guarantee complete security due to risks such as unauthorized access or hardware/software failure. Customer accounts are protected by a User ID and password for security. It is the Customer’s responsibility to protect their password and limit access to their account and device by signing off after using the service. If a password or account has been disclosed to an unauthorized person, Customers must notify us immediately.

Emmet Internet will not ask for sensitive Personal Information like social security numbers, bank account details, or credit card numbers through email or text messages. If you receive such requests from someone claiming to be from Emmet Internet, please contact our Privacy Administrator immediately at [email protected].

With prior consent, Emmet Internet may access Customer’s computer desktop to assist with technical problems during specific sessions, but this access requires Customer’s knowledge and affirmative consent.

7. WHAT DISCLOSURE CHOICES DO CUSTOMERS HAVE?

Customers can always choose not to disclose Personal Information to Emmet Internet; however, certain Personal Information is necessary for Emmet Internet to provide the Service to the Customer. Customers may opt out of sharing Personal Information with Our Affiliates only for marketing or advertising purposes, but not for business or operational purposes. Customers may opt out of email marketing and advertising from Emmet Internet or its Affiliates using the “Unsubscribe” mechanism in each email.

Before Emmet Internet sends a Customer a text for any reason, or sends a Customer a pre-recorded call that contains advertising or marketing information, Emmet Internet will secure Customer’s prior written express consent, which can be given via a voice recording, email, text message, postal mail, or telephone key press. Non-telemarketing pre-recorded calls do not require Customer’s prior express consent in writing, unless they are sent to a wireless device. Customers understand, acknowledge, and agree that such texts and pre-recorded telemarketing calls may be sent using an autodialer and are not conditioned on the Customer’s purchase of the Service.

Customers may opt out of receiving text messages at any time by replying “STOP” or “UNSUBSCRIBE” to the text message. Customers may opt out of receiving pre-recorded calls by following the opt-out instructions in the call. Customers can also request to be added to Emmet Internet’s company-specific Do Not Call list to opt out of advertising and marketing calls of all types. However, Customers will continue to receive calls related to debt collection and their current Service.

Customers may also opt out of First Party Advertising, but not Contextual Advertising, as detailed in the “Use of Personal Information for Marketing or Advertising Purposes” section above. Customers may not opt out of Emmet Internet’s use of cookies or other similar technology, or the use of Customer’s Personal Information and Non-Personal Information for Emmet Internet’s internal analytics used to monitor activity on Emmet Internet’s website, measure Emmet Internet’s Service performance, or to operate and protect the Emmet Internet Network.

8. WHAT PERSONAL INFORMATION CAN CUSTOMERS ACCESS, MODIFY AND/OR DELETE?

Generally, Customers may access the following Personal Information in their account:

  • Full name

  • Email address

  • Telephone number

  • Billing and Service address

  • Account and billing information

By contacting Emmet Internet at [email protected], or through any online access portal and/or via telephone, Emmet Internet may enable Customers to view, access, and modify their account settings, and in some cases, edit or delete the Personal Information listed above. Emmet Internet will retain historic email, billing, and/or Service addresses for security and verification purposes, and Customers may not delete such information even after the subscription expires or terminates. Existing Customers may not delete any Personal Information because such information is necessary to provide and bill for the Services; Customers may only update or modify the following Personal Information:

  • Full name

  • Email address

  • Telephone number

  • Billing address

  • Account and billing information

Emmet Internet may use any aggregated data derived from Customer’s Personal Information but not in a manner that would identify Customer personally. Emmet Internet may also maintain Personal Information regarding Customers and their use of the Service after they are no longer an Emmet Internet customer as required by Emmet Internet’s business practices, by law, and/or tax reporting purposes. The information Customers can view, update, and delete may also change if required by law. If Customers have any questions about viewing or updating information Emmet Internet has on file about them, please contact Emmet Internet at [email protected].

9. WILL THIS PRIVACY POLICY EVER CHANGE?

Yes, Emmet Internet is constantly working to improve the Service, so Emmet Internet will need to update this Privacy Policy from time to time as Emmet Internet’s business practices change and service offerings increase, and/or there are changes in local, state, or federal laws. Emmet Internet will also make stylistic, organizational, and/or grammatical changes to present Emmet Internet privacy practices in a user-friendly, easy-to-read manner.

Emmet Internet will alert Customers to any such changes by placing a notice on Emmet Internet’s Site and App with the effective date of the revised Privacy Policy, and/or by sending Customers an email, or by some other means to the extent required by law. Please note that if Customers have not provided Emmet Internet with their email address or have not updated their contact information, those legal notices will still govern Customer use of the Service, and Customers are still responsible for reading and understanding all notices posted on Emmet Internet’s website.

Customers’ continued use of the Service or website after notice of any changes has been provided will indicate their acceptance of such changes, except where further steps are required by applicable law. Use of Customer’s Personal Information is primarily governed by the Privacy Policy in effect at the time the Customer subscribed to the Service or visited the Emmet Internet website.

If Emmet Internet elects to use or disclose Personal Information that identifies the Customer as an individual in a manner that is materially different than that stated in the Privacy Policy in effect at the time the Customer subscribed to the Service or visited the Emmet Internet Site, Emmet Internet will provide the Customer with an opportunity to consent to such use or disclosure. Depending on the circumstances, that consent may include an opt-out.
